Terms and Conditions for Photography Services

1. Agreement Overview
By booking photography services with PhotoMyrtleBeach, the client agrees to these terms and conditions. The services provided are subject to the following terms, which may be updated from time to time.

2. Scope of Services
PhotoMyrtleBeach agrees to provide photography services as outlined in the agreed-upon contract or service agreement, including but not limited to:

Event photography (e.g., weddings, corporate events)

Portrait sessions
-
Product photography
-
Other customized services as specified in the contract
The client agrees to provide accurate and clear instructions about their desired services prior to the session.

3. Payment Terms
A $100 retainer fee is required to secure the booking for any photography session with PhotoMyrtleBeach. This retainer fee will go towards the total balance of the session. The retainer is non-refundable, but the client may use it towards a future session if they are in the area again. All sales are final, and the retainer fee will not be refunded under any circumstances except as specified for future use. Final payments for the session are due on or before the event/session date unless otherwise agreed. Failure to make payment by the due date may result in the cancellation of services.

4. Rescheduling and Cancellations
If the client decides to cancel the session, the $100 retainer fee will be forfeited and will not be refunded. However, the client has the option to reschedule the session for a different date when they are next visiting the area. The rescheduled session must be booked within 15 months from the original session date, and the original retainer fee will be applied toward the new booking. If the client fails to reschedule within this time frame, the retainer fee will not be applied to future bookings.

5. Deliverables
All photographs will be delivered the next business day, around midnight, after full payment has been completed. Photos will be provided in the format agreed upon in the contract. PhotoMyrtleBeach reserves the right to use its discretion when selecting final images.

6. Copyright and Usage Rights
PhotoMyrtleBeach retains copyright over all images captured during the session. The client is granted a personal, non-exclusive license to use the images for personal use, including social media and prints. Commercial use of the images without prior written permission is prohibited.

7. Client Consent for Communication
By agreeing to these Terms and Conditions, the client consents to being contacted by PhotoMyrtleBeach via text message (SMS) and email for business-related purposes. This may include session reminders, updates, payment notifications, or promotional offers. The client may opt-out of receiving such communications at any time by replying “STOP” to any SMS received or by informing PhotoMyrtleBeach in writing.

8. Liability
PhotoMyrtleBeach will take all reasonable care in the delivery of services; however, is not liable for any injury, loss, or damage to the client or others during the photography session. In the event of technical issues (e.g., camera failure), PhotoMyrtleBeach will attempt to reschedule or refund part of the payment if no satisfactory images are provided.

9. Client Responsibilities
The client agrees to cooperate during the photography session and follow the photographer's instructions.
10. Force Majeure
Neither party shall be liable for failure to perform under these terms if such failure is due to causes beyond their reasonable control, including but not limited to natural disasters, illness, or other unforeseen events. PhotoMyrtleBeachwill make its best effort to reschedule the session in such circumstances. However, if the client decides to cancel instead of rescheduling, the $100 retainer fee will not be refundable.

11. Governing Law
These terms and conditions are governed by the laws of the state of South Carolina, United States. Any legal disputes will be resolved in Horry County, South Carolina.
